I-Services SETA ithatha izinyathelo zokubuyisela ubulungiswa  kulabo abampimpa abaphula umthetho

I-Services Sector Education and Training Authority (Services SETA) izibophezele ekubuyiseleni ubulungiswa kubasebenzi abaxoshwa emsebenzini ngemva kokuphakamisa ukukhathazeka ngezinsolo zokungahambi kahle, okukhombisa ushintsho oluya ekuvikelweni okuqinile kwaba mpimpa izaphula mthetho (whistleblowers).

Ekhuluma esithangamini sabezindaba ngoLwesihlanu lomhlaka 20 Mashi, uMphathi we-Services SETA, uLehlogonolo Masoga, uchaze izinyathelo ezithathwayo ukubhekana namacala ahlobene nabasebenzi abathathu bangaphambilini okukholelwa ukuthi bathola ukuhlukunyezwa emsebenzini ngenxa yokwenza izambulo ezivikelwe ngumthetho.

Lesi sithangami silandela umbiko wakamuva kaNgqongqoshe Wezemfundo Ephakeme Nokuqeqeshwa, uButi Manamela, mayelana nenqubekelaphambili ezinhlanganweni ezifakwe ngaphansi kokuphathwa (administration), okubalwa kuzo ne-Services SETA.

UMasoga uthe le nhlangano yenze ukubuyekezwa okuphelele kwezomthetho, okubandakanya ukuhlolwa kwangaphakathi, ukuhlolwa okuzimele kwangaphandle kanye nemibono yabeluleki bezomthetho abaphezulu, ukuze kutholakale ukuthi ukuxoshwa kwakuhlotshaniswa yini nemisebenzi yokudalula ubugebengu.

“Inqubo iqondiswe indlela yokubuyisela ubulungiswa egxile kulabo abahlukunyeziwe, iqinisekisa ukulunga, ukungafihli lutho kanye nokuvikelwa kwalabo abasebenze ngenhloso yomphakathi,” kusho uMasoga ePitoli.

Lesi sinyathelo siza ngesikhathi kukhula ukunakwa kazwelonke mayelana nokuvikelwa kwabavezi bobubi, ikakhulukazi kulandela amazwi kaMongameli Cyril Ramaphosa ngesikhathi ethula Inkulumo Yesizwe  yango-2026, lapho aphinde waqinisekisa izinhlelo zokwethula umthetho ozokwenza kube yicala ukuphindiselela kubavezi bobubi.

UMasoga ugcizelele ukuthi imithetho ekhona, okuhlanganisa i-Protected Disclosures Act 26 ka-2000 kanye ne-Labour Relations Act, ivimbela noma yiluphi uhlobo lokuhlukunyezwa emsebenzini kubasebenzi abadalula ukungalungi ngenhloso enhle.

Amacala abuyekezwayo

Ukubuyekezwa kugxile kubasebenzi abathathu bangaphambilini abaxoshwa phakathi kuka-2017 no-2020.

Mayelana nodaba lukaLehloma Ramajoe, uMasoga uthe ucwaningo oluzimele luqinisekisile ukuthi lo msebenzi wahlukunyezwa emsebenzini njengoba wajeziswa, wamiswa noma waxoshwa “ngenxa, ngenxa, yokuthi wenze isambulo esivikelwe.”

URamajoe uthi wadalula ulwazi lokuphathwa kabi ngaphakathi kwe-Services SETA kubantu noma izinhlaka okungenani eziyisikhombisa, okubalwa kuzo owayengosihlalo ababili bangaphambilini be-Services SETA; iNational Skills Authority; iKomidi lePhalamende (okungenzeka kube eleMfundo Ephakeme Nokuqeqeshwa); owayenguNgqongqoshe Wezemfundo Ephakeme; uMvikeli Womphakathi; kanye ne-OUTA.

“Kuqinisekiswe ngokuzimela ukuthi uMnu Ramajoe uhlukunyeziwe emsebenzini njengoba wajeziswa, wamiswa noma waxoshwa ngenxa,  ngenxa, yokwenza isambulo esivikelwe. Lokhu kusho ukuthi uMphathi kufanele amnike isinxephezelo ngokuhambisana nezinhlinzeko zesigaba 193 noma 194 se-Labour Relations Act,” kusho uMasoga.

Mayelana noThandi Mkhize, uMasoga uthe kunezizathu ezanele zokuphetha ngokuthi wahlaselwa ngemva kokuphakamisa ukukhathazeka ngokungahambi kahle. Njengoba esefinyelele eminyakeni yokuthatha umhlalaphansi, sekucatshangelwa isinxephezelo njengendlela efanele yokulungisa udaba.

NgoJulayi 2017, uMkhize wabekwa amacala okungaziphathi kahle ngokusabalalisa ulwazi kumalungu enyunyana mayelana nodaba alubeka njengolungahambi kahle. Wabe esexoshwa, kanti imizamo yakhe yokuphikisa ukuxoshwa e-CCMA naseNkantolo Yezabasebenzi ayiphumelelanga.

“Ngokubuyekezwa kwamaqiniso enginawo kanye nezeluleko zomthetho, kunezizathu ezanele zokuphetha ngokuthi lo msebenzi wahlaselwa ngamabomu futhi kungenzeka wahlukunyezwa emsebenzini ngenxa yokuphakamisa izindaba zokungahambi kahle ngokwe-Protected Disclosures Act,” kusho uMasoga.

Endabeni kaTshepiso Mofokeng (Mngceke), imiphumela ikhombisa ukuthi ukuxoshwa kwakhe kwalandela ukungaboni ngaso linye nabaphathi ngezinsolo zokuphathwa kabi, okubalwa kuzo ukukhathazeka mayelana nokuqokwa komhlinzeki wesevisi. Yize kwakukhona isivumelwano sangaphambilini, udaba luhlangabezana nemibandela yesambulo esivikelwe futhi lungase ludinge ezinye izinyathelo zokulungisa.

UMasoga uvumile ukuthi kube nokwehluleka ngaphakathi kwenhlangano .

Uphinde wathi inqubo yokubuyekezwa kwabavezi bobubi iqhubeka kanye nemizamo yokubamba labo ababandakanyeka ekungahambi kahle ngaphakathi kwenhlangano.

UMasoga uthe indlela ethathwayo ibonisa imigomo yobulungiswa obubuyiselayo, okubalwa kuzo ukuqashelwa komonakalo, ukubandakanywa kwalabo abathintekile kanye nokuqinisekisa izinyathelo zokulungisa.

Ubalule ukuthi abavezi bobubi bavame ukubhekana nemiphumela emibi kakhulu, okubalwa ukulahlekelwa yimisebenzi kanye , , nokusongelwa ngokuphepha kwabo.

UMasoga uphinde waqinisekisa ukuzibophezela kwe-Services SETA ekuletheni ubulungiswa ngokuthatha izinyathelo ezisheshayo  ngenhloso yokuphathwa kahle.

“Ngifisa ukusho ngokucacile ukuthi i-Services SETA inomgomo wayo wangaphakathi mayelana nabavezi bobubi, kanti le nqubo ihambisana neminye imizamo yokuqinisekisa ukuthi kuthathwa izinyathelo eziqinile kulabo abenze okungahambi kahle nokungaziphathi kahle. Isinqumo sikaNgqongqoshe sokufaka le nhlangano ngaphansi kokuphathwa sasinhlose, phakathi kokunye, ukubhekana nalezi zinselelo.
